WHY?

There’s no denying we all love Apache Shores and want it to be great for years to come. Many people are against raising the annual dues from $35 to $100, but there is simply no way things can stay sustainable at this rate.

Please help in casting your vote by November 3rd, and spreading the word to neighbors. We’re not trying to turn Apache into something it’s not ? we just want to make much needed improvements and set ourselves up for the future.

WHY SHOULD WE VOTE YES? WELL, HERE ARE SOME ANSWERS.

The Regular Assessment and Maintenance Fee are one and the same. It is the annual fee owed by property owners for each lot. A Special Assessment is in addition to the Regular Assessment / Maintenance Fee and must be approved by a majority vote of the members (property owners) present at an annual or special meeting at which a quorum is met.

No, each year is stand alone! This is totally driven by each years budget plan. If the budget does not exceed the prior years budget by < 5% the board can approve the increase. If it increase by more than 5% then it must be approved by membership (property owners).

Yes, but only by going through the same process as we are currently going through to put this declaration in place. Voting by each section and reaching a 50% plus one passing of a change to a current declaration.

If the amendment is adopted in your section Apache Club membership fee will go away for your section. However, usage fees will remain.

No, it will remain in place for those in your section that want to use the amenities, but the membership and fee will be increased (TBD).

No, you will receive 2 Hang Tags for parking with payment of your dues.

Immediately upon payment of the Regular Assessment, and any usage fee if applicable.

With payment of Regular Assessment, and usage fee if required: Boat Launch/Parking, Pool, Sports Courts, Volleyball Court, Soccer Field, Community Hall, Disc Golf, Indian Creek Hiking Trail. The Lakeside Park and the Children’s Park are available to all owners

Yes, the Lakeside Park, Children?s Park, Disc Golf, Soccer Field, and Hiking Trails only.

$100.00 total per lot. $35.00 to the General Fund and $65.00 to funds that support the sections voting in the Declaration.

No, it replaces the $35.00 Assessment. This is an increase of $65.00.

The $100.00 Regular Assessment is per lot owned, just like the $35.00 Assessment is today.

There is not a Homestead exemption for the regular assessment.

The $100.00 can increase up to NTE 5% by board approval if the budget does not exceed 5% over the prior year. Any budget more than 5% must be approved by majority vote of the members or special meeting of the members at which a quorum is met.

In addition to the Regular Assessment the board can propose a Special Assessment in any particular year when the boards feels it is necessary to carry out the duties of the Association. As an example, the pool fails because of a significant leak. The repair is structural, requiring repair, resurfacing, tile and walk area to be replaced. The project does not fit into the annual budget. The board develops a Special Assessment and proposes it to the community for vote.  The Special Assessment must be approved by a majority vote of the Members at an annual or special meeting of the Members at which a quorum is met.

Each section has a single stand alone legal document and can only be adopted by each approving section.

The board will propose rules & regs, the authority and enforcement, including any fines associated, if approve by majority vote of the board. The rule or reg will be submitted to Members for a majority vote by Members or special meeting at which a quorum is met.

Yes, the $35.00 will go to the general fund for all of  Apache and the $65.00 will benefit only those sections approving the amendment.

Members holding 10% of the votes cast in person or by ballot, or Members present at any meeting at which a quorum is present.
